the Sea, _Ocean Isle Beach, NC 28469 THIS WILL BE A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA
VACATION RENTAL ACT. THE RIGHTS AND
OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE
UNIQUE PROVISIONS PERMITTING THE DISBURSMENT OF RENT PRIOR TO TENANCY AND
EXPEDITED EVICTION OF TENANTS. YOUR
SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE
PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE
AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL. Please note that we advise you to read all of the information
provided herein regarding property 266 Bldg 6-D Starboard-by-the-Sea and our
rules so misunderstandings or inconveniences might be prevented.
If there are any contradictions between this document and other
information on the website, this document shall take precedence.
Rules and regulations are subject to change from time to time, but the
rules applying to your rental shall be those as written and in force at the time
and date of your execution of this agreement. CONFIRMATION AND DEPOSIT Please fill in information completely, initial each page and sign
the last page of the contract as confirmation of your agreement.
Mail the signed copy to us with a check for the $200.00 Security deposit PLUS 50% of the total rental charge (see Deposits and
Final Payments below). Payments may
be made by personal check. We will
continue to market the property for rent until receipt of your initial payment.
Upon our deposit of your initial payment, your contract with us is bound. If for any reason the
property has already been rented to another party when we receive the check, we
will promptly contact you for alternate dates or return the check to you. RULES AND REGULATIONS Check-in time is after 3:00 pm on the first day, according to your
reservation. You may go straight to
the condo when you arrive. If upon
arrival you discover any damage to the property notify us immediately at
910-755-5092. If you plan to arrive
early, let us know and we will see if the unit can be made available earlier.
During your stay, report any non emergency problems to the above number
or email to ______________. Problems
will be attended to promptly. 1.No pets of any
kind are allowed in rental property. If
a pet is discovered on the premises occupancy will be terminated with no refund
and your security deposit will be forfeited. 2.Absolutely no
smoking in the condo or outside decks.
Smoking on the premises may result in immediate termination of occupancy
with no refund and your security deposit will be forfeited.
3.Absolutely no
house parties. Should a house
party occur in the rental unit, occupancy will be terminated with no refund and
your security deposit will be forfeited. 4.The rental amount
being charged is based, in part, on the number in the party.
Under no circumstances should there be more than 8 overnight
occupants. Violations of
this provision will result in termination of occupancy with no refund and
forfeit of security deposit. 5.Pillows,
bedspreads and some blankets are provided.
We recommend that you bring extras.
Linens, towels, paper products, cleaning supplies, and toiletries are not
provided. The unit has 1 Queen bed, 2 Double beds, 1 single bed and a
double futon. 6.Fireworks are not
legal in North Carolina. This
ordinance is enforced a violators are subject to a $500.00 fine. 7.The tennis courts
and swimming pools at Starboard are for owners and renters only.
We will leave 2 cards in the condo for you to use for access to these
facilities. If you lose a card
there will be a fee of $25.00 to replace the card.
Please leave the cards on
the counter in the living area when you leave.
8.We have a wine
cooler in the living area. Please
feel free to use it, but do not change the settings on the cooler. 9.No mobile
sleeping units such as campers may be used in the condo for sleeping, cooking or
any other purpose other than transportation. 10.
Parking for this unit is designated by the D on the building over the
parking bay. You may only park
under the building in this parking bay. The
bay will accommodate two vehicles. 11.
If you lock yourself out of your unit, please call 910-755-5092.
We will attempt to get you a new key.
If you cannot reach us you may call Jo Ann Messick at 910-540-7124 If you cannot reach her you
must call and pay a locksmith to
get inside. 12.
We will do our best to keep all equipment in good repair.
When you check in or during your stay, if you discover anything not in
working order, please notify us at the above number and we will correct it as
soon as possible. There will be no
rebates given due to the malfunctioning or breakdown of appliances, TVs, air
conditioning, etc. DEPARTURE 13.
Cleaning: 1 Generally tidy up the place and make sure everything is in
order as you found it. 2. Empty all food out of the refrigerator and wine cooler.
3. Load and start dishwasher, 4. Empty trash cans and place in outdoor
trash containers. 14.
Before departing make sure all appliances are turned off except
refrigerator. During warm months
please set air conditioner to 80 degrees. During
winter months set heat to 55 degrees. In
early spring and late fall turn off thermostat before leaving. 15.
Please lock the front door and leave keys as directed.
Check-out time is 10:00 AM. No
one is to be in the unit or on unit property after check-out time.
The property will be inspected after your departure. Renter
is responsible for damage incurred during his occupancy of the premises.
We will not be responsible for accidents, injury, or loss of valuables.
If damage does occur in the unit please report it immediately.
We can repair while you are there and alleviate any questions for both
parties. DEPOSITS AND FINAL PAYMENTS 16.
The total rental Charge is split between two payments.
The first is due with the executed contract.
The final payment is due exactly one month prior to your arrival date. When we receive your final payment we will send an email with
additional information and key instructions. If the final payment is not received by the due date, your
reservation will be canceled and your initial payment will be refunded, less
15%, only if the unit is re-rented at the market rate, otherwise you forfeit all
deposits. 17.
If you cancel the reservation at any time, any payments that you made
will be refunded, less 15% only if the unit is re-rented, otherwise all deposits
are forfeited. 18.
There will be no refund for inclement weather except mandatory
evacuations. In the event of
mandatory evacuations the pro-rata share of the rental charge will be refunded. 19.
Any and all interest earned on deposits and advance rents paid will
accrue to our benefit and not the renter. 20.
If for any reason we are unable to deliver the property to you for the
rental period contracted, (for example, the unit is damaged by a hurricane), we shall
refund your money in full, including interest at a rate of 5% APR, calculated
from the time your money was first deposited by us, until the date refund check
was mailed 21.
There will be a $27.00 charge for any returned check. 22.
Renter’s security deposit will be refunded if the unit is left in
satisfactory condition and the keys are returned as per our instructions.

along with a copy of this contract, signed below and initialed on each
page. Upon receipt of the final
payment, renter will be sent a key to access the unit and any additional
information needed. The undersigned understands and agree to the terms of this rental
contract. This contract represents
