THIS IS A VACATION RENTAL AGREEMENT COVERED UNDER THE NORTH CAROLINA VACATION RENTAL ACT.  THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS IF SPECIFIC RULES ARE VIOLATED.  YOUR SIGNATURE ON THIS AGREEMENT OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND TERMS HEREIN.

Note:  Should there be any contradictions between this document and any other information presented on any website regarding the rental of  627 Kings Trail Drive, Sunset Beach, NC,  this document shall take precedence.

 

RULES AND REGULATIONS (Please read carefully)

  1. Check-in time is 3:00pm on the first day of your reservation.  You may go straight to the property when you arrive and obtain a key according to the pre-established instructions that you will receive following final payment of rental fee.
  2. Upon arrival, should you note any obvious damage of the property, please report it immediately to (919)368-7316.
  3. No pets.  No smoking on the premises.  No house parties.  Security deposit will be forfeited and immediate eviction from property will result if these rules are violated.
  4. No guests, other than those listed by the renter in this agreement, may reside on the property during the rental period.
  5. Pillows, bedspreads and some blankets are provided.  Linens, paper towels and paper products are not provided.  Linens are available for rent through several companies listed below that will deliver and pick-up from the property, so please reserve your linens.  The bed configuration for the property is K,Q,Q,F,F,T,T so rent only what you need.  The following companies rent linens:
  6. Kitchen telephone is for local calls only.
  7. Locked closets contain owner’s property and should not be tampered with for any reason.
  8. Any sports or recreational equipment is available for use at your own risk but will require replacement if anything is damaged, lost or destroyed.  Please return anything that you use to where you found it.
  9. The hot tub is non-functional and will eventually be replaced.  DO NOT USE!
  10. Fireworks are not legal in North Carolina.  The ordinance is enforced and violators are subject to a $500.00 fine.
  11. All renters are subject to Sea Trail rules and regulations which will be available for your inspection at the property.
  12. Please keep track of keys after they are issued.  You will be provided with 2 keys.  Should they become lost, you will be required to contact a locksmith and have replacements made at your own expense.  Security deposits will not be refunded until keys are returned.
  13. Trash pick-up is early Wednesday morning.  Please roll your trash to the end of the driveway the night before.  Neighborhood rules require it to be returned to the house that day, following pick-up.
  14. A key card is required for entrance to the pool, tennis court and fitness center.  You will find the card in the basket on the counter.   
  15. If there is anything that is not in working order during your stay, please contact Gail at (919)368-7316 for instructions.  No rebate will be given for malfunctioning or breakdown of equipment or appliances, but we will work quickly to have repairs made.
  16. Ripe vegetables may be picked from the garden and be used during your stay.  Please pick only what you will use during your rental of the property.

 

DEPARTURE REQUIREMENTS

  1. Check-out time is 11:00am.  No one should be on the property after that time.
  2. Remove linens from beds and place on front porch in the corner for pick-up.
  3. Close and lock all windows and doors.
  4. Turn AC (if summer) to 80 degrees, and HEAT (if winter) to 60 degrees.  If thermostats were set to OFF when you arrived, turn them back off.  There are 2 HVAC units for the property.  Please adjust them both according to these instructions before you leave.
  5. Make sure that outdoor gas grill is OFF, and that there are no embers in fire pit before covering.
  6. Make sure all kitchen appliances are clean, turned off and put back in their original positions.
  7. CLEANING:  There is a cleaning fee of $130 which is required, for your convenience and our assurance that the property will be ready for the next renter.  However, please launder anything that you may have used from our inventory (i.e. dishcloths, dishtowels etc.) and return them to the drawer.
  8. Please report any minor mishaps, i.e. breakages of glasses, dishes etc. so that we can ensure adequate inventory for future renters.

 

CONFIRMATION, DEPOSITS AND FINAL PAYMENT

Please read and fill out the entire document and return all 3 pages  to us with a $300 Security Deposit plus 50% of the agreed upon Rental Fee.  Balance of rent plus cleaning fee must be received not later than 3 weeks before the first day of the designated rental period.  Checks should be made payable to:  Gail Didsbury and mailed to 1100 Bearglades Lane, Raleigh NC  27615.  A $40 fee will be charged for any returned checks.

 

You may want to make a copy of the document for your records.

 

Cancellations made prior to final rental payment due date will be refunded, less a $200 service charge.

 

Security Deposits will be refunded if the property is left in satisfactory condition and RULES and REGULATIONS  have been adhered to.  Keys must be mailed back to owner(Gail Didsbury 1100 Bearglades Lane, Raleigh, NC  27615) before the security deposit is released.  Refunds will be made within 7 days of receipt of keys and satisfactory inspection of the property.

 

Long term renters (in excess of one month) may be subject to different requirements than outlined above, so contact us if you fall into that category.

Make checks payable to Gail Didsbury and mail checks and signed contract to:  Gail Didsbury 1100 Bearglades Lane Raleigh, NC  27615.*  Security Deposit plus 50% Rent is due now to hold your property.  Taxes, Maid Service Fee and 50% Rental Balance is due 3 weeks prior to check-in date.  The contract is bound upon our receipt and deposit of the Renters First Payment and Security Deposit.

 

The Undersigned has read, understands and fully agrees to the terms of this rental contract and it’s rules and regulations.  This represents the full contract between the parties.
