Rental Contract – Rules and Regulations

THIS WILL BE A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

  1. Check-in Time is after 2:00 PM on the first day, according to your reservation. You may go straight to the house when you arrive. You do not need to go by any office. If you anticipate arriving after 8:00 PM, please let owner know your ETA by email or phone.
  2. Pillows, bedspreads and some blankets are provided. Linens and towels are provided free upon request. Your beds will be made when you arrive (if requested). Paper products, cleaning supplies, and toiletries are NOT provided. Toilet paper (one roll) will be in each bathroom. I try to keep hotel soaps in drawers and a new tooth brush in the master bath for someone who forgot theirs.
  3. During your stay, report any problems at mobile phone 919-819-7018 (0r text information to same number). Problems will be attended to promptly.
  4. No pets of any kind are allowed in the rental property. If a pet is discovered on the premises, occupancy will be terminated with no refund. Owner is local and neighbors will notify me if any abnormalities occur. There are local vets who offer over night pet stays at affordable rates. (Info available upon request)
  5. Absolutely NO SMOKING in the house or on the property, including the boat dock. Smoking on the premises may result in immediate termination of occupancy with no refund.
  6. Absolutely NO IRRESPONSIBLE HOUSE PARTIES. Should a wild/loud party occur in the rental unit, occupancy will be terminated with no refund. Owner is local and keeps close supervision as do neighbors. Police will be knocking on the door with notice… Ocean Isle is a family beach and a strict noise curfew is enforced for your convenience and that of owners and other island guests. If you experience a loud group nearby, you may call the police to complain (not 911 but local number 910- 579-4221. This non-emergency number will also be listed on rules sheet on fridge. For local emergencies, 911 is also an option for your safety.
  7. 5 decks are available for pleasure with seating provided on each. No horseplay/leaning/jumping is permitted. No climbing/sunning allowed on roof. Death can occur in an accidental fall from any deck/roof. Strict supervision is the responsibility of the renters.
  8. Each Renter is responsible for clearing the rental property before leaving. A specific checklist is on the refrigerator in the rental unit. WHEN YOU LEAVE: 1.Generally tidy up the place and make sure every thing is in order as you found it, when you arrived. 2. Clear all food out of refrigerator. 3. Run dishwasher. 4. Empty trash cans and place the outdoor trash container at the street. 5. Lock all windows and doors. 6. Return all keys to the storage place. It is your responsibility to leave the home in a respectable manner, for the hired maid service (scrubbing bathrooms, mopping floors, refrigerator cleaning, vacuuming etc). Strip linens from beds and leave in laundry room. It is your responsibility to report any damage prior to your departure. Any left/forgotten items should be immediately reported to owner before next guest arrives. Items will be kept for one week (if found), then donated to local charity if unclaimed. If at all possible, important found items will be safely returned to renter with ample notice. (i.e. device chargers, favorite stuffed animals- postage will be deducted from security deposit)
  9. Renter is responsible for any damage incurred during his occupancy of the premises. We will not be held responsible for accidents, injury, or loss of valuables.
  10. Renter’s Security Deposit will be refunded, if the unit is left in satisfactory condition. Refunds will be mailed within 30 days of the Renter’s last day at the unit.
  11. Close and lock all doors and windows, and make sure all appliances are turned off, except the refrigerator, before departing. During air conditioning times, please turn the unit to 80 degrees upon departure. During heat months, please set heat to the lowest setting upon departure. In early spring and late fall, please turn the thermostat off, when leaving. Please be comfortable while renting, but keep thermostat temperatures at a reasonable level and remember to close windows and doors to prevent wasted energy use. Thanks!
  12. Check-out time is 10:00 A.M., SHARP. No one is to be in the unit or on the unit property after check-out time. Cleaners will be on site at 10:15.
  13. Reservations may be made anytime and will be honored, provided signed contract and payment is received as agreed and is deposited.
  14. There is no telephone in the house, you must use your cell phones. There is wireless and password will be provided on instructions on refrigerator. A wireless printer is available; ink levels and paper level are not checked each week. IF you are needing the printer for work/emergencies, please advise in advance and owner will check printer for black ink.
  15. Rental Deposits will be refunded on cancellations, less 15%, when/if the unit is re-rented.
  16. There will be no refund for inclement weather, except mandatory evacuations. In the event of mandatory evacuation, the pro-rata share of the rental charge will be refunded.
  17. Any and all interest earned on deposits and advance rents paid will accrue to our benefit, and not the Renter. (ha ha) but this is a required legal disclosure)
  18. If you use any of the recreational/sporting equipment, you agree to use it with care, and repair or replace anything which you damage, destroy, or lose. For example, the bicycles are located under the house, but if you use them and one is lost, we ask that you go to Wal-Mart and replace it with one of like kind.
  19. Rental Charge is based, in part, on number in party. Under no circumstances should there be more than 16 overnight occupants. Violation of this provision may result in termination of occupancy, without refund. IF there is unusual water/electrical usage during your stay, additional charges may occur. Please supervise children in regards to water/electrical usage. For filling kiddie pool, or slip and slide, or hosing off beach chairs please use hose near dock. This faucet is tied into the second irrigation meter.
  20. If for any reason we are unable to deliver the property to you for the rental period contracted (for example, the home is damaged by a hurricane), we shall refund your money in full.
  21. RESERVATION FEE: Unlike the local real estate rental companies, we DO NOT charge reservation FEES.
  22. CONFIRMATION DEPOSIT: We will not send you a rental agreement. You should print this document, and sign and date each page as confirmation of your agreement. Then you should mail the contract to Martha Worsley at 1726 Lake Tree Dr, Ocean Isle Beach, NC 28469 along with deposit. The deposit is 50% of the gross amount due including tax and security deposit. This payment may be paid by personal check. THERE WILL BE A THIRTY FIVE DOLLAR CHARGE FOR ANY RETURNED CHECK. We will continue to market the property for rent until receipt of your deposit check. Upon our deposit of your initial check, your contract with us is bound. Please send a self-addressed stamped envelope with your check. If for any reason the property has already been rented to another party when we receive the check, we will promptly return it to you in this envelope; otherwise, we will use the envelope to return your security deposit, at the appropriate time (item 10 above).
  23. BALANCE OF PAYMENT: The balance on the rent, all taxes and security deposit is due 30 days before arrival date. NO REMINDERS WILL BE SENT.
  24. Please be aware that the locked closets are property of the owner and are not to be entered under any conditions. If upon arrival you discover any damage to the property PLEASE NOTIFY US IMMEDIATELY AT 919-819-7018 (MOBILE #).
  25. INSPECTION OF PROPERTIES: The property shall be inspected after your departure. If damage does occur in the unit, please do not feel embarrassed, but report the damage to us immediately. We can handle the repair while you are here and alleviate any questions of both parties. If it is discovered that the owner's closet has been broken into after your departure, you will be charged the full replacement cost for all items that are missing plus any expenses that are incurred to replace the missing items.
  26. If you plan on arriving early, let us know via email and we will see if the unit can be made available earlier. If you arrive early, you may want to visit the Coastal Carolina Museum, shop in the various retail shops or dine at one of the local restaurants. During summer months, a children’s program is offered free of charge for children age 3 – 12 at the Ocean Isle Community Center Monday - Thursday. Friday night concerts are a favorite at Ocean Isle, and are at 6:30 in parking lot of the museum. Bring your chairs/blanket and picnic and join the family fun. See local tv program guide or OIB website for a listing of bands. If available schedule will be posted on fridge. A donation is taken for local food pantry, but concert is free. IF you have canned food left over that you would like to donate to local food pantry you can take it to concert, or leave on counter and owner will donate said items.
  27. KEYS: Keys are located at the rental house. We will email you where to find the key upon receipt of the final payment and no less than 15 days prior to your arrival. Keys will not be given out to anyone other than the person whose name is on the reservation (or email address above), unless we have been given previous authorization.
  28. LOCK OUTS: If you lock yourself out of your unit, please call 919-8197018 and leave a message. (Or text). Your call will be returned promptly and arrangements made to have a key brought to you. There will be a $20.00 lost key fee if keys are lost.
  29. MAINTENANCE AND REPAIRS: We will do our best to keep all equipment in good repair. When you check in or during your stay, if you discover anything not in working order, please notify us immediately, at 919-819-7018. We will correct it as soon as possible.
  30. There will be NO REBATES given due to the malfunctioning or breakdown of appliances, air conditioning, televisions, telephones, computer, fax machine, printer, or any other property equipment or services.
  31. OCCUPANCY: The maximum number of people allowed at 7 Leland St is 16, or the # agreed upon below, whichever is less. The city ordinance does not allow additional guests to sleep in vehicles parked on the property or on board boats or outside campers. We rent to FAMILIES AND RESPONSIBLE ADULTS GROUPS (If the group is a non-family adult group, all occupants must be over 25 years of age). Misrepresentation of the party will result in immediate termination of the rental agreement, expulsion, and the loss of rental fee. In addition, there is a $20 per person per night charge for each overnight guest greater than the number represented by the renter below. We reserve the right to refuse occupancy, if we feel the occupancy could be detrimental to the property.
  32. PETS: ABSOLUTELY NO PETS ALLOWED INSIDE OR OUTSIDE OF THE RENTAL PROPERTY. IF A PET IS FOUND YOU WILL BE CHARGED A NON-REFUNDABLE FEE OF $125.00. YOUR SECURITY DEPOSIT WILL BE FORFEITED, YOU WILL BE ASKED TO REMOVE THE PET IMMEDIATELY OR VACATE THE PREMISES WITH NO REFUND.
  33. EVEN THOUGH WE DO NOT ASSUME RESPONSIBILITY FOR ANY ITEMS LEFT IN PROPERTY, we will make every effort to locate lost items. Upon request, we will mail items found to you. These items will be shipped and postage deducted from security deposit.

MAIL: If you must have mail sent to you while on vacation, the mailing address is 7 Leland Street, OIB, NC 28469. A mail box is located on property.

GARBAGE PICK-UP: Garbage pick-up during the summer months is on Monday, Thursday and Saturday. The containers must be placed at the street by 7:00 a.m. FIREWORKS: Fireworks are not legal in North Carolina. A $500.00 fine will be enforced.
VEHICLES: No mobile sleeping units, such as campers, may be used at cottages for sleeping, cooking or any purpose other than transportation.
THIS IS A NON-SMOKING UNIT

PLEASE NOTE THAT WE ADVISE YOU TO READ ALL OF THE INFORMATION PROVIDED HEREIN REGARDING 7 LELAND STREET (and other rentals) AND OUR RULES SO THAT MISUNDERSTANDINGS OR INCONVENIENCES MIGHT BE PREVENTED. IF THERE ARE ANY CONTRADICTIONS BETWEEN THIS DOCUMENT AND OTHER INFORMATION ON THE WEBSITE, THIS DOCUMENT SHALL TAKE PRECEDENCE. RULES AND REGULATIONS ARE SUBJECT TO CHANGE FROM TIME TO TIME, BUT THE RULES APPLYING TO YOUR RENTAL, SHALL BE THOSE AS WRITTEN AND IN FORCE AT THE TIME AND DATE OF YOUR EXECUTION OF THIS AGREEMENT.

  2. The kayak is not for the surf; it is for the canal use only. With your reply, you agree to abide by these rules. No one under 90 pounds can use the kayak unless they are with an adult. If any passenger is under 21, there must be adult supervision. (also life vests are required see note below)

     

    All passengers must be wearing a properly fastened life vest. There is one adult life vest and a youth vest provided. The kayak is not to be left in the water overnight or during inclement weather.

     

    WE HIGHLY RECOMMEND WEARING SHOES. IF YOU SHOULD ACCIDENTALLY FLIP ONE OF THE KAYAKS AND NEED TO EXIT BY WALKING ON THE SIDE OF THE CANAL WATERWAYS, THERE ARE MANY OYSTER SHELLS IN SOME AREAS, WHICH WILL CUT UP BARE FEET.

     

    The kayak should be lifted by the straps on each end, and should be stored upside down. All renters are required to acknowledge their agreement to our rules for kayak use.

TERMS AND CONDITIONS:

This vehicle is a converted golf cart such that it complies with NC laws for Street Vehicles. The golf cart is referred to as a Street Car, since it is tagged and licensed to operate on public roads in the state of North Carolina. It will go approximately 25MPH and is equipped with blinkers, horn, headlights, taillights, and 6 seatbelts. Capacity on cart at any time is 6.

Operation of the Street Car is restricted to LICENSED adults 21 years of age and older AND who are specifically listed and have signed above. By their signature above, each person certifies they comply with the provisions of this paragraph and this entire agreement. Persons using Street Cars agree to keep the cars on the Island (do not drive onto main Island Bridge) and obey all N.C. traffic rules and regulations. Street Cars are NOT allowed on the beach.

The Lessee will be responsible for repairing damage they cause to the Street Car while in the Lessee’s possession. The rental period ends 12 hours prior to the end of the house rental agreement for 7 Leland Street (generally that is midnight on Friday). Please leave golf cart charging for next renter’s use. The golf cart will be inspected upon your departure. Any damage should be reported prior to departure. The charge for a Lost Key is $20 per key. If for any reason the Lessee has the Street Car and is unable to get it back to the house, Lessee should NOT attempt to tow or pull on their own, but contact Owner. Be sure to charge after each use to prevent stranding.

The Lessee will assume full responsibility for anyone who is injured while riding in the Street Car. The Lessee will notify owner as soon as possible if there is accident or injury. Owner assumes no responsibility for accidents that occur due to negligence or fault of the driver.

Lessee agrees to indemnify and hold owner harmless against any loss, damage, or liability (including attorney’s fees) arising out of the negligent or reckless operation of his (her) family members, or guests.
